    為深入貫徹落實黨中央、國務院決策部署,有力有序推進生態保護修復領域重大工程建設,現將《生態保護修復中央預算內投資專項管理辦法》印發給你們,請結合實際認真執行。

    生態保護修復中央預算內投資專項管理辦法



    第一章  總則



    第一條  根據《政府投資條例》及中央預算內投資管理等有關規定,為加強和規范生態保護修復中央預算內投資專項管理,保障項目順利實施,提高資金使用效益,結合項目管理特點,制定本辦法。



    第二條  本辦法適用于生態保護修復項目中央預算內投資的申報、審核、下達和監管等。其中,農業綠色發展地方項目的申報、下達與執行、監督檢查與績效評估等按照《國家發展改革委辦公廳農業農村部辦公廳關于中央預算內投資補助地方農業項目投資計劃管理有關問題的通知》(發改辦農經〔2019〕302號)有關規定執行。



    第三條  本專項按照“大專項+任務清單”模式管理,全部為約束性任務。堅持公平公正、急用優先、程序完備、綜合監管的原則,平等對待各類投資主體。本專項中央預算內投資應用于計劃新開工或續建項目,原則上不得用于已完工項目。



    第四條  專項實施期限原則上為5年,如實施期滿仍需繼續執行,按照有關規定重新申請設立。



    第二章  支持范圍、方式和標準



    第五條  本專項主要用于納入《全國重要生態系統保護和修復重大工程總體規劃(2021—2035年)》及其專項建設規劃、《三北工程六期規劃》中符合支持方向的重點區域生態保護修復項目;《生態保護和修復支撐體系重大工程建設規劃(2021—2035年)》《國家公園等自然保護地建設及野生動植物保護重大工程建設規劃(2021—2035年)》以及其他相關國家級專項規劃中部署的生態保護支撐體系項目;畜禽糞污資源化利用、農業面源污染治理、長江生物多樣性保護、草原畜牧業轉型升級等相關國家級專項規劃(實施方案)部署的農業綠色發展項目。具體包括:



    (一)“雙重”“三北”等重點區域生態保護修復項目,包括營造林、退化草原修復、濕地保護修復(主要支持國際重要濕地、國家重要濕地、濕地類型的國家級自然保護區等重要濕地保護基礎設施、退化濕地修復、科研監測等建設內容)、沙化荒漠化石漠化治理及水源工程、節水灌溉、谷坊等小型水利水保設施等建設內容,并對項目內的木本糧油基地予以統籌支持。



    (二)重點生態資源保護項目,包括森林草原防滅火、林草種質資源保存及攻關、管護站點、生態保護修復重大工程監測監管評估系統建設等。



    (三)野生動植物保護及自然保護地建設項目,包括國家公園、國家級自然保護區等重要自然保護地保護管理和科研監測設施建設,野生動植物保護及設施裝備建設等。



    (四)林業行業及執法能力建設項目,包括重點地區綠化、林業科技創新能力、林業執法監管能力、國有林區公用基礎設施建設等。



    (五)畜禽糞污資源化利用項目,以畜禽養殖大縣為重點,支持畜禽糞污收集、貯存、處理、利用等環節的基礎設施建設。



    (六)農業面源污染治理項目,以長江、黃河流域為重點,兼顧其他重要流域,優先選擇水環境敏感區和糧食主產區,重點支持農田面源污染、畜禽養殖污染、水產養殖污染防治基礎設施項目建設。



    (七)長江生物多樣性保護工程項目,以長江流域“一江兩湖七河和332個水生生物保護區”等禁捕退捕縣(市、區)為重點區域,重點支持珍稀瀕危物種資源保護、關鍵棲息地保護及修復、漁政執法能力建設、水生生物資源及棲息地監測、水生生物保護技術能力提升等方面基礎設施建設。



    (八)草原畜牧業轉型升級項目,以牧區和半牧區省(區)為重點,支持高產穩產優質飼草基地、現代化草原生態牧場或標準化規模養殖場、優良種畜和飼草種子擴繁基地、防災減災飼草貯運體系等方面基礎設施建設。



    (九)其他項目,包括國務院或國家發展改革委批準、印發的其他生態保護修復、農業綠色發展等方面規劃內的相關項目。



    第六條  本專項主要支持市場不能有效配置資源的非經營性項目。專項資金原則上按項目安排,以直接投資方式為主;對確需支持的經營性項目,主要采取資本金注入方式,也可以適當采取投資補助、貸款貼息等方式。



    第七條  根據中央和地方事權劃分原則、所在區域經濟社會發展水平等情況,實施差別化的中央預算內投資支持政策。具體支持標準如下:



    (一)“雙重”“三北”等重點區域生態保護修復項目,東部、中部、西部、東北地區(含參照相關政策執行的地區,下同)中央預算內投資支持比例分別為60%、70%、80%、80%;濕地保護修復項目按照80%執行。



    (二)重點生態資源保護項目,其中森林草原防滅火項目東部、中部、西部、東北地區中央預算內投資支持比例分別為60%、70%、80%、80%,其中森林防火應急道路建設中央預算內投資最高不超過新建50萬元/公里、改造30萬元/公里;國家級林草種質資源保存庫項目中央預算內投資支持比例為80%,鄉土樹種保供繁育基地、采種良種基地、草種基地項目中央預算內投資支持比例為40%;管護用房建設項目,中央預算內投資定額支持標準為新建或重建改造35萬元/個、加固改造或移動管護用房25萬元/個、功能完善10萬元/個。



    (三)野生動植物保護及自然保護地建設項目,包括國家公園、國家級自然保護區等重要自然保護地保護管理和科研監測設施建設項目,野生動植物保護及設施裝備建設項目,中央預算內投資支持比例為80%。



    (四)林業行業及執法能力建設項目,其中重點地區綠化項目中央預算內投資支持比例為100%;林業科技創新能力、國有林區公用基礎設施建設項目中央預算內投資支持比例為80%;林業執法監管能力建設項目,中央預算內投資定額支持標準為一級站40萬元/個、二級站30萬元/個。



    (五)畜禽糞污資源化利用項目、農業面源污染治理項目、草原畜牧業轉型升級項目,中央預算內投資支持比例為50%,同時畜禽糞污資源化利用項目每個縣支持總金額不超過3000萬元,農業面源污染治理項目每個縣支持總金額不超過5000萬元,草原畜牧業轉型升級項目每個縣支持年度金額不超過5000萬元。



    (六)長江生物多樣性保護工程項目,東部、中部、西部中央預算內投資支持比例分別為40%、50%、60%。



    (七)由國家有關行業主管部門管理的中央單位和西藏、新疆生產建設兵團項目,中央預算內投資支持比例為100%(鄉土樹種保供繁育基地、采種良種基地、草種基地建設及其他定額支持項目、新疆生產建設兵團畜禽糞污資源化利用及草原畜牧業轉型升級項目除外);其他計劃單列企業集團或中央管理企業項目參照項目所在地中央預算內投資支持標準執行。



    (八)其他建設項目,依據相關建設規劃或方案明確的支持標準執行。



    第八條  本專項中央預算內投資,重點區域生態保護修復項目、生態保護支撐體系項目(重點地區綠化項目除外),主要采取直接下達到具體項目的方式,原則上不打捆或切塊下達;農業綠色發展項目,根據項目情況采取打捆下達或直接下達到具體項目的方式。



    第九條  各省、自治區、直轄市和計劃單列市、新疆生產建設兵團發展改革部門及有關行業主管部門、國家有關行業主管部門、計劃單列企業集團和中央管理企業分別作為項目匯總申報單位。



    項目匯總申報單位應對申報項目承擔審核責任,確保項目前期工作依法合規,資金使用科學規范,申報材料真實可信。督促項目單位根據投資能力,統籌采取加大地方財政及自有資金投入、合理使用國債、地方專項債券和政策性開發性金融工具、爭取各類貸款等多種方式,保障項目建設資金需求。



    第三章  投資計劃申報



    第十條  項目單位要根據相關國家級專項規劃、國家有關行業標準或規范,扎實做好申請使用本專項資金的項目前期工作,明確建設內容、建設規模、建設地點、投資概算及來源、完成時限,確保前期工作達到規定的深度和質量。項目單位被列入嚴重失信主體名單的,不得申請中央預算內投資支持。



    第十一條  申請使用本專項中央預算內投資計劃的項目,必須按規定完成項目建議書和可行性研究報告的審批或項目備案程序。列入相關國家級專項規劃的項目視同已經批復項目建議書。初步設計提出的投資概算超過經批準的可行性研究報告估算總投資10%的,項目單位應當向可行性研究報告審批或備案部門報告,審批或備案部門可以要求項目單位重新報送可行性研究報告。



    第十二條  項目匯總申報單位應加強投資項目儲備,合理提出年度建設任務并測算資金需求,及時將符合條件的項目納入國家重大建設項目庫。入庫項目應根據項目前期工作進展情況,及時動態更新填報、逐步補充完善項目信息,并對有關信息的真實性、合規性負責。



    第十三條  資金申請報告由項目單位提出,按程序報送項目匯總申報單位。項目匯總申報單位應對資金申請報告進行審核,并匯總報送國家發展改革委。資金申請報告可以單獨報送,或者與年度投資計劃申請合并報送。



    對于由國家有關行業主管部門管理的中央單位項目資金申請報告或年度投資計劃申請報告,由國家有關行業主管部門審核后按要求報送國家發展改革委。其他計劃單列企業集團或中央管理企業項目資金申請報告或年度投資計劃申請報告,由計劃單列企業集團或中央管理企業審核后按要求報送國家發展改革委。地方項目資金申請報告或年度投資計劃申請報告,由省級發展改革部門會同有關行業主管部門,按要求聯合報送國家發展改革委和國家有關行業主管部門。



    項目匯總申報單位申報年度投資計劃時,應按規定填報績效目標,并隨投資計劃一并報送。同步在國家重大建設項目庫推送項目,并確保入庫信息與項目前期工作批復、年度投資計劃申報文件一致。



    第十四條  項目匯總申報單位應對申報材料的真實性、合規性負責,并對申報項目是否符合本專項支持范圍和支持標準、是否存在多頭重復超額申報中央預算內投資及其他中央財政建設性資金、是否完成審批或備案程序、是否落實中央預算內投資之外的其他資金、項目單位是否被納入嚴重失信主體名單等信息進行嚴格審查,確保新開工項目前期工作成熟、在建項目報建手續完備,避免計劃下達后形成沉淀資金。



    第十五條  項目單位申請本專項投資計劃,應當綜合評估當地政府投資能力和財政承受能力,確保不新增地方政府債務風險,項目匯總申報單位應加強審核把關。



    第十六條  項目匯總申報單位申報投資計劃,應明確申報計劃中每個項目的項目單位和項目負責人、日常監管直接責任單位及監管責任人,并經日常監管直接責任單位及監管責任人認可。



    第四章  投資計劃下達與執行



    第十七條  國家發展改革委受理資金申請報告后,對相關事項進行審查,并視情況依據《國家發展改革委投資咨詢評估管理辦法》有關規定,委托相關單位進行評估。被委托單位應組織專家對資金申請報告進行評審,核定符合本專項支持范圍的投資規模。對于同意安排中央預算內投資的項目,國家發展改革委應當批復其資金申請報告。資金申請報告可以單獨批復,或者在下達投資計劃時合并批復。



    由國家有關行業主管部門匯總申報的項目,投資計劃由國家發展改革委審核后下達國家有關行業主管部門,并同步下達績效目標。其他計劃單列企業集團或中央管理企業匯總申報的項目,投資計劃由國家發展改革委審核后下達計劃單列企業集團或中央管理企業,并同步下達績效目標。對地方匯總申報的項目,投資計劃由國家發展改革委會同國家有關行業主管部門進行審核和綜合平衡后,下達有關省級發展改革、行業主管部門,并同步下達績效目標。對農業綠色發展項目,投資計劃由國家發展改革委審核和綜合平衡后,下達農業農村部、有關省級發展改革部門,并同步下達績效目標。



    第十八條  中央預算內投資計劃中已經明確到具體項目的,項目匯總申報單位應在收到下達文件后10個工作日內轉發下達投資計劃;采取打捆方式的,項目匯總申報單位應在收到文件20個工作日內分解下達到具體項目,及時在重大建設項目庫填報分解下達信息,并對計劃分解下達資金的合規性負責。



    分解下達投資計劃時,要落實和明確每個項目的項目單位及項目責任人、日常監管直接責任單位及監管責任人,經日常監管直接責任單位和監管責任人認可后填報入庫。禁止向依法列入嚴重失信主體名單的項目單位分解下達投資計劃。



    第十九條  項目匯總申報單位轉發或分解下達中央預算內投資計劃時,要督促和支持項目單位加強財力統籌,及時足額落實有關建設資金。



    第二十條  本專項中央預算內年度投資計劃在執行過程中確需調整的,應嚴格執行投資計劃調整的有關規定和程序,及時調整用于可形成有效支出的項目。調入項目應符合本專項有關要求,能夠及時開工建設或已開工建設,安排的中央投資不應超過已確定的或根據本專項支持標準計算的中央預算內投資支持規模。



    第二十一條  項目單位要嚴格落實投資計劃執行的主體責任,在收到中央預算內投資計劃后要盡快開工建設。依法嚴格執行項目法人責任制、招標投標制、建設監理制和合同管理制,對項目的建設質量及進度、資金管理和生產安全負責。項目建成后,項目單位應當及時申請或組織竣工驗收。項目審批或備案部門應嚴格按照國家有關規定組織開展項目驗收。



    第二十二條  項目驗收后,必須及時辦理移交手續,明確產權,落實運行主體和管護責任,加強建后管護機制建設,積極探索靈活、有效的管護機制,鼓勵通過專業隊伍管護、承包管護、林農(牧民)自管等多種模式,落實管護措施,確保項目建設成果得到鞏固,長期發揮效益。



    第二十三條  項目單位要建立健全資金使用管理的各項規章制度,嚴格按照批準的項目建設內容、規模和標準使用資金,嚴禁轉移、侵占和挪用項目建設資金。



    第五章  監督檢查與績效評估



    第二十四條  日常監管直接責任單位承擔項目監管主體責任,負責項目實施、建設管理、計劃執行、資金撥付與使用等重點環節的日常監督管理,督促項目單位規范項目管理和資金使用,確保建設質量和投資效益。



    第二十五條  項目匯總申報單位應通過日常調度、在線監測、現場監督檢查等方式,加強對項目實施、計劃執行等情況的監管,發現問題要及時督促項目單位整改處理。每月10日前,應督促項目單位通過國家重大建設項目庫及時準確完整填報項目開工情況、投資完成情況、形象進度、竣工驗收等數據和信息,同步上傳項目進度和資金支付使用等資料,并加強審核(涉密項目按有關規定執行)。



    第二十六條  國家發展改革委、國家有關行業主管部門應通過全國投資項目在線審批監管平臺(國家重大建設項目庫)定期跟蹤、動態掌握本專項計劃執行情況,必要時可采取督促自查、組織相互抽檢、實地督查、委托第三方評估等方式對項目實施情況加強監管,并將各類檢查結果作為后續中央預算內投資安排的重要參考。



    第二十七條  對各級發展改革、有關行業主管部門及財政、審計、監察等部門依據職能進行的各類監督檢查,項目單位和有關設計、施工、監理等單位應予以配合,如實提供有關情況及文件資料。



    第二十八條  國家發展改革委、國家有關行業主管部門應每年對本專項投資計劃執行、投資項目實施、績效目標實現等情況組織開展自評,形成年度績效評估報告,并將績效評估結果作為后續年度優化專項設置、完善專項管理、安排投資計劃的重要依據。



    對發現的未及時準確完整通過國家重大建設項目庫填報項目信息、項目實施和計劃執行進度不符合要求、績效評估結果較差等問題的地方和單位,將視情況采取調減下年度中央預算內投資規模、暫緩受理中央預算內投資計劃申請等懲戒措施。



    第六章  附則



    第二十九條  本辦法由國家發展改革委負責解釋。



    第三十條  項目匯總申報單位可根據本辦法,制定本單位管理辦法,細化實化投資申報、計劃下達、項目實施、竣工驗收、監督檢查、信息報送等方面的要求。



    第三十一條  本辦法自印發之日起施行,有效期5年,原2021年發布的《重點區域生態保護和修復中央預算內投資專項管理辦法》《生態保護和修復支撐體系中央預算內投資專項管理辦法》以及《農業綠色發展中央預算內投資專項管理辦法》同時廢止。
